Terms of Service

These Terms of Service ("Terms") govern your use of the EchoAnswers website and AI voice receptionist platform ("Service") operated by Echo Answers LLC, an Arizona limited liability company doing business as EchoAnswers ("EchoAnswers," "we," "us," or "our"). By using the Service, including by checking "I agree" at sign-up, you agree to these Terms, the Guarantee & Refund policy below, and our Privacy Policy.

These Terms are provided in English. If a translated version is made available, the English version controls in the event of any conflict. Estos Términos se proporcionan en inglés. Si se pone a disposición una versión traducida, la versión en inglés prevalece en caso de cualquier conflicto.

The Service

EchoAnswers provides an AI phone receptionist that answers calls, answers questions from the information you provide, transfers calls, captures messages and voicemail, and can capture and book appointments. It is automated software, not a human. Features vary by plan and configuration, and AI-generated responses may be inaccurate; you are responsible for reviewing the business information, prices, and policies you configure in the Service.

No uptime guarantee: response, not availability

EchoAnswers does not guarantee uninterrupted or error-free service. The Service runs on third-party AI and telephony infrastructure and outages may occur. We commit to a reasonable response time to issues, not to a specific uptime percentage. Nothing on our website or in our marketing (such as "always on" or "never miss a call") is a guarantee of availability.

Plan & changes

Our plan, "The Front Desk," is $99 per month and includes 600 voice minutes; additional minutes are billed at $0.50 per minute. We may change prices or features on reasonable notice; changes apply to future billing periods.

Acceptable use

You agree not to use the Service:

• For any unlawful, harassing, fraudulent, or abusive purpose, or to transmit such content.
• For high-risk uses, including emergency or life-safety lines.
• To handle protected health information (PHI) or other regulated data that would require a separate signed agreement (such as a HIPAA Business Associate Agreement), which we do not currently offer.
• To interfere with the operation of the Service or third-party networks.

You are responsible for complying with applicable telemarketing, call-recording, and privacy laws, and for obtaining any consent required from your callers (see our Privacy Policy).

Guarantee & refund policy

• 30-day money-back guarantee. The $99 monthly base fee is refundable within 30 days of your first paid charge.
• Overage is non-refundable. Per-minute overage charges ($0.50/minute) reflect real usage cost and are not refundable.
• One-time, per account. The guarantee applies once per business.
• How to claim. Email hello@echoanswers.ai; an approved refund is issued to your original payment card via Stripe.
• Cancellation is not a refund. Cancelling stops future charges and is not retroactive; charges outside the 30-day window are not refunded.

Termination

Either party may cancel at any time. Cancellation stops future charges; it is not retroactive beyond the refund window above. We may suspend or terminate access for violation of these Terms or for non-payment.

Third-party services

The Service relies on third-party providers (including telephony, AI, payment, and hosting vendors). Your use may also be subject to those providers' terms. We are not responsible for outages or changes outside our reasonable control.

Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. AI-generated responses may be inaccurate; you are responsible for reviewing critical business policies configured in the Service.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHOANSWERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE FEES YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Governing law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law rules.
